Terms of Service

Effective Date: 15 June 2025 These Terms of Service ("Terms") govern your access to and use of the EventsPOP mobile application and related services (collectively, the "Platform") operated by EventsPOP ("we", "us", or "our"). By creating an account, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Platform.
1. Eligibility
You must be at least 18 years of age to use EventsPOP. By registering, you represent and warrant that: • You are 18 years of age or older; • You have the legal capacity to enter into a binding contract under the laws of Kenya; • You are not barred from using the Platform under any applicable law; • All information you provide is accurate, current, and complete. We reserve the right to terminate any account where age eligibility cannot be confirmed.
2. What EventsPOP Is
EventsPOP is an online marketplace that connects independent event talent (ushers, brand ambassadors, event hosts, concierge, and related roles) with hirers who require staffing for events and activations in Kenya. EventsPOP is a technology platform only. We do not employ, supervise, direct, or control the work of any talent listed on the Platform. Talent are independent contractors operating their own businesses. EventsPOP does not guarantee the quality, safety, legality, or suitability of any talent or gig posted. The contract for services is formed directly between the hirer and the talent.
3. Account Registration
You must register for an account to use most features of the Platform. You are responsible for: • Providing accurate registration information; • Maintaining the confidentiality of your password; • All activity that occurs under your account; • Notifying us immediately of any unauthorised use at legal@eventspop.org. You may not create more than one account, transfer your account to another person, or share your login credentials.
4. User Roles
The Platform supports two primary roles: Talent — individuals who create profiles to offer their event staffing services and apply for or receive booking invitations. Hirers — individuals or organisations who post gig requirements and engage talent through the Platform. You must select your role at registration. Talent and Hirers are subject to additional role-specific obligations set out in Sections 9 and 10 respectively.
5. Identity Verification (Talent)
To protect the safety of all users, talent are required to complete identity verification before accepting paid bookings. Verification requires: • A valid government-issued photo ID (national ID, passport, or driving licence); • A live selfie for facial verification purposes. Verification is reviewed by our Trust & Safety team. Approval is at our sole discretion. Verification confirms identity only — it does not constitute an endorsement, background clearance, or guarantee of conduct. We retain verification documents in accordance with our Privacy Policy. You may request deletion of these documents by contacting privacy@eventspop.org, subject to our legal retention obligations.
6. Booking Process
Hirers post gig requirements specifying role, date, location, duration, and rate. Our matching system identifies eligible talent and sends invitations. Talent may accept or decline invitations. A booking is confirmed when the required number of talent have accepted and the hirer's payment has been received and placed in escrow. EventsPOP reserves the right to cancel or modify any booking that violates these Terms, at no liability to EventsPOP.
7. Fees and Payment
Platform Service Fee: EventsPOP charges a service fee to both parties on every completed transaction: • Hirers are charged 10% of the total talent cost, added to their payment at checkout. Example: if talent cost is KSh 10,000, the hirer pays KSh 11,000. • Talent have 10% deducted from their agreed shift rate. Example: a shift rate of KSh 10,000 results in a payout of KSh 9,000. Both fees are displayed clearly before any payment is confirmed. By proceeding with a booking, both parties accept these fees. Escrow: Hirer payments are held in escrow by EventsPOP from the time of booking confirmation until the gig is completed and any applicable dispute window has passed. EventsPOP does not release funds until the gig is marked complete and no valid dispute is pending. Payouts: Talent receive payment via M-Pesa to their registered payout number. Payouts are typically processed within 3–5 business days of gig completion, subject to dispute resolution. EventsPOP reserves the right to withhold payment pending investigation of a reported incident, cancellation dispute, or compliance review. Taxes: Talent are independent contractors and are solely responsible for declaring and paying all applicable taxes, NSSF, NHIF, and other statutory deductions on income earned through the Platform. EventsPOP does not withhold PAYE or any other tax on talent earnings. Hirers are responsible for their own tax obligations with respect to contractor payments.
8. Cancellation Policy
Hirer Cancellations: • Cancelled more than 72 hours before the gig: full refund of hirer payment; no payment to talent. • Cancelled 24–72 hours before the gig: 50% of the talent fee is paid to confirmed talent as a cancellation fee; 50% refunded to hirer. • Cancelled less than 24 hours before the gig, or after talent have checked in: 100% of the talent fee is paid to confirmed talent; no refund to hirer. Platform service fees are non-refundable in all cases. Talent Cancellations: If talent cancels a confirmed booking, no payment is due to that talent for the cancelled shift. The talent's reliability score will be affected. Repeated cancellations may result in account suspension. Force Majeure: In the event of circumstances beyond reasonable control (natural disasters, government-mandated shutdowns, or similar), EventsPOP will determine cancellation treatment on a case-by-case basis.
9. Talent Obligations
As talent on the Platform, you agree to: • Maintain an accurate and up-to-date profile reflecting your skills, availability, and categories; • Arrive on time and fulfil the full requirements of each confirmed booking; • Conduct yourself professionally and in compliance with the hirer's reasonable instructions and venue rules; • Not consume alcohol or controlled substances during working hours; • Not share confidential information about the hirer's event, clients, or business; • Maintain your own valid work authorisation in Kenya; • Not solicit hirers to transact with you outside of the Platform for the duration of any booking and for 12 months after your last booking with that hirer; • Report any safety concern, harassment, or misconduct promptly via the in-app incident reporting system.
10. Hirer Obligations
As a hirer on the Platform, you agree to: • Provide accurate, complete, and lawful gig descriptions; • Ensure a safe and lawful working environment for all talent; • Not engage in, permit, or tolerate harassment, abuse, or discrimination of any kind toward talent; • Pay all amounts due through the Platform; you must not arrange off-platform payment for bookings initiated through EventsPOP; • Not solicit talent to work for you outside of the Platform for the duration of any booking and for 12 months after your last booking with that talent; • Accurately record attendance and promptly mark gigs as complete once finished.
11. Ratings and Reliability
Both talent and hirers may be rated following completed gigs. Ratings are visible on the Platform and influence matching decisions. Talent are assigned a Reliability Score based on attendance, punctuality, and completion rate. A low Reliability Score may result in reduced matching priority or account suspension. Ratings must be honest and based on genuine experience. Posting false, misleading, or retaliatory reviews is prohibited and may result in account termination.
12. Prohibited Conduct
You must not use the Platform to: • Provide false or misleading information; • Harass, abuse, threaten, or discriminate against any other user; • Post or transmit unlawful, defamatory, or harmful content; • Engage in fraudulent activity, including false gig claims or fabricated check-ins; • Circumvent the Platform's payment systems or solicit off-platform transactions; • Create multiple accounts or impersonate another person; • Upload another person's personal or identity documents without their consent; • Engage in any activity that violates Kenyan law or applicable international law; • Attempt to reverse-engineer, scrape, or interfere with the Platform's systems. Violation of this section may result in immediate account suspension or permanent ban without notice.
13. Trust, Safety, and Incident Reporting
Your safety is our priority. The Platform provides in-app incident reporting for: • Safety emergencies (SOS) • Harassment or abuse • No-shows and misconduct • Payment disputes All reports are reviewed by our Trust & Safety team. We may share incident information with law enforcement where required by law or where there is an imminent risk to any person's safety. Submitting a false incident report is a violation of these Terms.
14. Account Suspension and Termination
We may suspend or terminate your account at any time, with or without notice, for: • Breach of these Terms; • Behaviour that risks the safety of other users; • Fraudulent, deceptive, or illegal activity; • Extended inactivity. Suspension is temporary and may be lifted upon resolution of the underlying issue. Disable means your account is deactivated; you cannot log in but your data is retained per our Privacy Policy. Permanent Ban means your account is permanently terminated and you may not register again. You may also delete your own account at any time from the Settings screen within the app. Upon account deletion, we will remove your personal data in accordance with our Privacy Policy, subject to legal retention obligations.
15. Dispute Resolution
In the event of a dispute between a talent and a hirer, you agree to first contact us at legal@eventspop.org to seek resolution through our internal process. Our Trust & Safety team will review the dispute and may request evidence from both parties. EventsPOP's determination of disputes is final with respect to payout decisions on the Platform. EventsPOP is not liable for any amount beyond the disputed booking value. For disputes that cannot be resolved through our internal process, both parties agree that disputes shall be governed by the laws of Kenya and submitted to the exclusive jurisdiction of the courts of Nairobi, Kenya.
16. Intellectual Property
All content, trademarks, logos, and software comprising the Platform are owned by or licensed to EventsPOP. You may not reproduce, copy, distribute, or create derivative works without our prior written consent. By submitting profile photos, bio content, or other materials to the Platform, you grant EventsPOP a non-exclusive, royalty-free, worldwide licence to display and use that content for the purposes of operating the Platform, including marketing of the Platform.
17. Limitation of Liability
To the fullest extent permitted by Kenyan law, EventsPOP shall not be liable for: • Any indirect, incidental, special, or consequential damages; • Loss of earnings, loss of data, or loss of opportunity arising from use of the Platform; • The conduct, acts, or omissions of any talent or hirer; • Personal injury or property damage occurring at a gig venue; • Service interruptions or Platform unavailability. Our total aggregate liability to you for any claim shall not exceed the amount of platform fees actually paid by you to EventsPOP in the three months preceding the claim.
18. Indemnification
You agree to defend, indemnify, and hold harmless EventsPOP and its officers, employees, and agents from any claims, losses, damages, or expenses (including legal fees) arising from: (a) your use of the Platform; (b) your breach of these Terms; (c) your violation of any third-party rights; or (d) any dispute between you and another user.
19. Governing Law
These Terms are governed by and construed in accordance with the laws of the Republic of Kenya. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Nairobi, Kenya.
20. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes via in-app notification or email at least 14 days before changes take effect. Continued use of the Platform after the effective date constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you must close your account before the effective date.
